Nature of Services Offered

SkillupAustralia provides consultation, sales, installation, and maintenance services for domestic hot water systems (HWS), including boilers, heat pump water heaters, and solar thermal collectors.

The services offered are of a technical and advisory nature. Our role is to provide compliant products, a professional installation, and qualified support to improve the energy efficiency of our clients' homes.

Limitations and Warranties

No Guarantee of Specific Savings Results

SkillupAustralia cannot and does not guarantee specific results related to:

• Achieving a specific percentage of energy savings on utility bills.
• Amortization of the investment within a predetermined period.
• Absolute performance of the system under abnormal climatic or usage conditions.

Energy savings and system performance depend on numerous factors beyond our control, including but not limited to: customer consumption habits, climatic conditions, system maintenance, the building's insulation status, and energy tariffs applied by the provider.

Customer Responsibility

The proper functioning and longevity of the system require the active cooperation of the customer. It is the customer's responsibility to:

• Use the system according to the instructions provided.
• Request scheduled maintenance according to the recommended deadlines.
• Promptly report any anomalies or malfunctions.
• Ensure the installation environment remains compliant with technical requirements.

Payment and Refund Policies

Payment Terms

Payments for SkillupAustralia services and products must be made according to the methods specified in the quote or contract (e.g., deposit on confirmation, balance on delivery/installation). We accept payments via bank transfer and other agreed-upon methods.

Refund Policy

Refunds are subject to the following conditions:

• Consultations and Site Visits: The cost of the site visit, if applicable, is non-refundable but may be deducted from the final installation cost.
• Installation Cancellation: The deposit paid is 100% refundable if cancellation occurs before materials are ordered. If materials have already been ordered, handling fees may be charged.
• Maintenance Contracts: You can withdraw from the annual contract with 30 days' notice; only the costs for services already performed will be retained.

No refunds are provided based on the failure to achieve a certain level of energy savings, as this depends on factors beyond our control.

Limitations of Liability

SkillupAustralia will not be liable for:

• Direct or indirect damages resulting from improper use of the system by the customer.
• Malfunctions due to force majeure (e.g., exceptional weather events, power surges on the electrical grid).
• Interventions or modifications to the system carried out by personnel not authorized by SkillupAustralia.
• Variations in energy costs that impact the calculation of expected savings.

Our liability is limited to the legal warranty on the products supplied (according to the manufacturer's specifications) and the warranty on the professionally executed installation. In no case shall our liability exceed the amount paid by the customer for the specific service.

Applicable Law and Jurisdiction

All relationships with SkillupAustralia are governed by the laws of Australia and the state of New South Wales. For any dispute that may arise, the courts of Sydney, New South Wales will have exclusive jurisdiction.

Before resorting to legal action, the parties agree to attempt an amicable resolution of the dispute.
